PASSENGER CHARTER AGREEMENT, WAIVER & SAFETY ACKNOWLEDGMENT

This Agreement is entered into between Sunset Cruises St. Pete, LLC (“Operator”) and the
undersigned Charterer (“Charterer”), on behalf of themselves and all guests.

1. Charter Type & Control

This is a passenger-for-hire charter operated by a United States Coast Guard-licensed Captain. Operator retains exclusive possession, command, and control of the vessel at all times. This is not a bareboat or demise charter.

2. Captain Authority

The Captain has absolute authority over vessel operation, safety, itinerary, and passenger conduct. Failure to follow instructions may result in immediate termination of the charter without refund.

3. Assumption of Risk

Charterer acknowledges that boating involves inherent risks, including vessel movement, weather, wakes, slips and falls, drowning, equipment failure, injury, property damage, and death. Charterer voluntarily assumes all such risks for themselves and their guests.

4. Release & Indemnification

To the fullest extent permitted by law, Charterer releases and agrees to indemnify and hold harmless Operator, its members, managers, employees, agents, captains, and crew from any claims arising from participation in the charter, except for gross negligence or intentional misconduct.

5. Safety Briefing Acknowledgment

Charterer acknowledges that, prior to departure, the Captain:

  • Explained required safety rules and conduct
  • Identified the location and use of safety equipment
  • Explained when life jackets must be worn

Charterer agrees to ensure all guests comply with Captain instructions at all times.

6. Rules & Guidelines

Charterer acknowledges that vessel rules and safety guidelines were explained verbally and are posted onboard or available upon request. Violations may result in fines or termination without refund.

7. Photo & Video Consent

Charterer consents to incidental photo, video, or audio recording during the charter and authorizes Operator to use such media for marketing or promotional purposes without compensation.

8. Governing Law

This Agreement is governed by federal maritime law and, where not preempted, the laws of the State of Florida.
